Official Contest Rules & Regulations

By entering any contest, giveaway, or promotion associated with the Oshawa Market Contest Program (“Contest Program”), entrants agree to these Official Rules & Regulations.

The Contest Program is operated in partnership with participating local businesses, promotional partners, sponsors, media partners, and associated websites.

1. Eligibility

1.1 Entrants must be legal residents of Ontario, Canada unless otherwise specified on an individual contest page.

1.2 Entrants must be at least 18 years of age at the time of entry unless otherwise stated.

1.3 Employees, contractors, immediate family members, and household members of contest organizers, sponsors, participating businesses, promotional partners, or associated companies may be ineligible for certain prizes.

1.4 Void where prohibited by law.

2. Contest Period

2.1 Each individual contest or giveaway will display its own:

  • start date
  • closing date
  • draw date
  • prize information

2.2 Organizers reserve the right to extend, shorten, modify, suspend, or cancel contests if necessary.

3. How To Enter

3.1 Entry methods will be described on the applicable contest page.

3.2 Entrants may enter one or multiple contests where permitted.

3.3 A valid email address may be required and may need to be verified before an entry becomes eligible.

3.4 Incomplete, duplicate, fraudulent, automated, or manipulated entries may be disqualified.

3.5 Organizers reserve the right to limit or reject entries where necessary to maintain fairness and system integrity.

4. Winner Selection

4.1 Winners will be selected by random draw unless otherwise specified.

4.2 Odds of winning depend on the total number of eligible entries received.

4.3 Selected winners may be required to correctly answer a mathematical skill-testing question in accordance with Canadian law.

4.4 Winners may be contacted by:

  • email
  • phone
  • social media
  • public announcement

4.5 If a selected winner:

  • cannot be contacted
  • fails verification
  • declines the prize
  • fails to respond within 5 business days
  • violates contest rules

another winner may be selected.

4.6 Organizers reserve the right to verify entrant eligibility and identity before awarding any prize.

5. Prizes

5.1 Individual prizes are supplied directly by participating businesses or sponsors (“Prize Sponsors”).

5.2 Prize Sponsors are solely responsible for:

  • prize fulfillment
  • delivery arrangements
  • product quality
  • warranty obligations
  • service scheduling
  • taxes or fees associated with their prize

5.3 Contest organizers and associated parties are not responsible for:

  • defective products
  • service disputes
  • sponsor cancellations
  • scheduling issues
  • delayed fulfillment
  • unavailable prizes
  • sponsor-related disputes

5.4 Prize values shown are approximate retail estimates only.

5.5 Prizes:

  • are non-transferable
  • may not be exchanged for cash unless stated otherwise
  • may be substituted with prizes of equal or greater value if required

6. Marketing & Communication Consent

6.1 By entering the Contest Program, entrants consent to receiving:

  • contest updates
  • winner announcements
  • sponsor promotions
  • future giveaways
  • promotional emails
  • campaign updates
  • community marketing communications

6.2 Entrants may unsubscribe from marketing emails at any time where applicable.

6.3 Entrants understand that participating businesses may receive entrant information relating to their specific sponsored contest or giveaway.

7. Privacy

7.1 Information collected may include:

  • name
  • email address
  • phone number
  • municipality
  • contest interests
  • marketing preferences

7.2 Information may be used for:

  • contest administration
  • winner selection
  • marketing communications
  • campaign analytics
  • sponsor promotions
  • future promotions
  • local business advertising

7.3 Information will not intentionally be sold to unrelated third parties outside the promotion ecosystem.

7.4 Organizers will take reasonable steps to protect collected information but cannot guarantee complete security of digital systems, websites, email platforms, or data transmissions.

8. Publicity Release

8.1 By accepting a prize, winners agree that organizers and participating businesses may use:

  • first name
  • municipality
  • photos
  • videos
  • social media content
  • winner announcements

for promotional purposes without additional compensation unless prohibited by law.

9. Technical Issues

9.1 Organizers are not responsible for:

  • website downtime
  • internet outages
  • failed submissions
  • QR code issues
  • software malfunctions
  • corrupted data
  • email delivery failures
  • unauthorized access
  • technical interruptions
  • hardware failures
  • server problems

9.2 Organizers reserve the right to suspend or modify contests if technical or operational problems compromise the integrity of the Contest Program.

10. Limitation Of Liability

10.1 By participating in the Contest Program, entrants agree to release and hold harmless:

  • contest organizers
  • promotional partners
  • participating sponsors
  • associated businesses
  • website operators
  • contractors
  • volunteers
  • employees
  • media partners

from any and all liability, claims, damages, injuries, losses, disputes, or expenses arising from:

  • contest participation
  • prize acceptance
  • prize usage
  • website usage
  • promotional activities
  • sponsor disputes
  • technical failures
  • marketing activities

10.2 Participation in the Contest Program is voluntary and entirely at the entrant’s own risk.

10.3 Under no circumstances shall organizers or associated parties be liable for indirect, incidental, consequential, special, or punitive damages.

11. Dispute Resolution & Legal Jurisdiction

11.1 By participating, entrants agree that any disputes relating to the Contest Program shall first be attempted to be resolved informally and in good faith.

11.2 Entrants agree that:

  • any claims shall be limited to actual out-of-pocket expenses directly associated with participation
  • consequential or punitive damages may not be sought
  • disputes shall be handled exclusively within Ontario, Canada

11.3 These Rules & Regulations shall be governed by the laws of Ontario and the applicable laws of Canada.

12. Organizer Rights

12.1 Organizers reserve the right to:

  • modify contest rules
  • remove entries
  • disqualify entrants
  • suspend contests
  • add or remove sponsors
  • update prizes
  • cancel promotions

at any time if necessary due to:

  • fraud
  • abuse
  • technical issues
  • legal concerns
  • operational issues
  • circumstances beyond reasonable control

13. Acceptance Of Rules

Participation in the Contest Program constitutes full and unconditional agreement to these Official Rules & Regulations.

14. Media, Photography & Promotional Content Consent

By participating in Durham Contests as a sponsor, giveaway provider, or prize partner, the participating business acknowledges and agrees that Durham Contests, AllAboutDurham, All About Web Services Inc., and associated media partners may photograph and/or film prize-related content where appropriate for promotional, editorial, social media, and marketing purposes.

This may include:

  • prize handoffs
  • winner announcements
  • installations
  • transformations
  • completed projects
  • sponsor interviews
  • related promotional footage

Examples of visually appropriate filmed prizes may include:

  • driveway projects
  • landscaping work
  • shed installations
  • equipment deliveries
  • home improvement projects
  • visible product or service transformations

Some prizes or services may not be suitable for filming due to privacy, personal, medical, or practical considerations.

Where appropriate, participating businesses and winners agree that approved photo and video content may be used across:

  • DurhamContests.com
  • AllAboutDurham platforms
  • social media platforms
  • promotional materials
  • TV displays
  • digital advertising
  • future promotional campaigns

Durham Contests reserves the right to determine what content is appropriate, reasonable, and suitable for promotional use.
